The police said in a statement the 25-year-old was arrested shortly before midday today.

They were unable to give more details as the case was before the courts.

Under tough new visa laws across the Tasman, anyone who has served a prison sentence of 12 months or more in Australia and is not a citizen can be deported.

Non-citizens without criminal convictions can also have visas cancelled on character grounds.

The government passed legislation under urgency on 18 November to set up a monitoring regime for deported New Zealanders.

It introduced parole-like conditions for anyone deported from Australia, or any other country, with criminal convictions.

Justice Minister Amy Adams had said, while those convicted of serious crimes in other countries had always been subject to deportation, numbers had increased under Australia's new policy.
