Foodstuffs wins ruling over North Shore site

A tussle between two supermarket chains over a site on Auckland's North Shore has been won by Foodstuffs.

The Environment Court has ruled that it can operate a Pak'n Save supermarket on the disputed site on Wairau Road. It will provide 250 jobs.

Foodstuffs has been fighting for 15 years to operate the Pak'n Save, even running an advertising campaign in 2005 to get the public onside.

Progressive Enterprises, which operates Countdown and Woolworths, fought the bid. However, the Environment Court ruled that the extra competition would be beneficial to consumers.

Since Foodstuffs was given resource consent for the Pak'n Save in 2004, the two sides have been to the High Court and the Court of Appeal.

Progressive Enterprises says it is considering lodging a further appeal.
