Wheel clamp company to appeal damages decision

A wheel clamping company says it plans to appeal against a decision by the Disputes Tribunal to award a motorist $550 in damages.

Glen Vickery's car was clamped after he parked in what he thought was a public carpark next to a row of shops in Manurewa, Auckland, last year. He had to pay $480 to remove it.

Mr Vickery took the case to the Disputes Tribunal, which has ruled that NZ Wheel Clamping's signs were ambiguous.

The tribunal also said the company would not disclose its terms of contract with businesses that owned the carpark, and therefore could not prove its right to clamp.

But NZ Wheel Clamping says it plans to appeal the decision and that it is never its intention to clamp vehicles that are legally parked.

It says it is working on establishing a code of standards with other parking enforcement organisations.
