Prasad's lawyers call Fiji police commissioner's actions unprecedented

The lawyers acting for the leader of Fiji's National Federation Party, Professor Biman Prasad, have revealed that he has been suing the husband of a woman who later made allegations against him.

The suit for the publication of false and defamatory statements in the Lautoka High Court also involves the Fiji Broadcasting Corporation.

AK Lawyers have commented following the collapse of a police attempt to charge Mr Prasad with "indecently insulting or annoying" Ari Taniguchi.

On Wednesday the Office of the Director of Public Prosecutions, or ODPP, announced that there was insufficient evidence to charge Mr Prasad and directed police not to proceed.

Mrs Taniguchi's allegations were made subsequent to Mr Prasad's defamation suit against her husband Hiroshi.

AK Lawyers said the Police Commissioner, Sitiveni Qiliho, when he arrested Mr Prasad would have, or should have, known that there was a pending legal action involving the complainant.

The lawyers said, as is standard practice, that they made representations to the ODPP, and they called the claim by the police commissioner that the office had contacted them "false and misleading."

AK Lawyers said they are deeply concerned at the manner in which the Commissioner then opted to publicise the decision of the ODPP, where amongt other things, he stated that the process adopted by the relevant office was "unprecedented".

They said the only unprecedented action was the commissioner holding a media conference to undermine and question the constitutional prosecutorial authority of Fiji.
