A man is facing charges of failing to use a condom during sex with a prostitute.
The 27-year-old, who has interim name suppression, appeared briefly in the Wellington District Court this morning, charged with two counts of failing to practise safe sex with a sex worker.
The charges relate to an incident in Wellington last October.
The man did not enter a plea and is due to reappear in court in May.
The safe-sex law is thought to have been applied only a small number of times since the Prostitution Reform Act was passed in 2003.
