The Vanuatu Supreme Court is to hear the first election petition arising from last month's election on November 17.

It is against successful National United Party candidate in the constituency of Malekula, Sanick Assang.

Assang was elected despite being on a suspended prison sentence for domestic violence and other crimes.

The petitioners are Gregoire Nimbtik and Fabian Gary Hanhabat Vinbel, who are both from the Vanua'aku Party, and were the next highest polling candidates in the seven member seat.

Assang is the first respondent, the second is the Principal Electoral Officer, the third respondent is the Electoral Commission, with the Commissioner of Police the fourth.

This is the first election petition since the snap election on October 13 to reach the office of the Supreme Court.

Assang was declared eligible to stand despite still serving a suspended sentence, which is contrary to the People's Representation act.
