The Fiji government has been given 14 days to file a response to affidavits filed by Freesoul Real Estate Development, which is facing charges over damage to the environment building a resort on Malolo island.

FBC News reports the case was called in the Nadi Magistrates Court on Friday.

Freesoul is accused of undertaking unauthorised developments and failed to comply with a prohibition notice under the Environment Management Act 2005.

Under the Act, if convicted, the company and its directors face fines of up to $US345,000 or a term of imprisonment of up to 10 years, or both.

The case has been adjourned to 21 February.
