Former ACT Party leader John Banks is returning to court to ask the retrial ordered by the Court of Appeal be scrapped.
Mr Banks was convicted last August of failing to declare two $25,000 donations from internet entrepreneur Kim Dotcom during his mayoralty campaign in 2010.
He took his case to the Court of Appeal, which overturned the conviction but ordered a retrial.
His legal team applied to recall the retrial judgement, leading to this new hearing.
Radio New Zealand understands the application from Mr Banks concerns evidence not yet heard in court around an alleged secret meeting between Mr Banks and Mr Dotcom.
