A bouncer is due to appear in Queenstown District Court on Monday, after footage of England rugby captain Mike Tindall was placed on the internet.
Jonathan Dixon is charged with accessing a computer system for dishonest purposes.
Closed circuit television footage from a bar in Queenstown, shows a man described as Tindall holding hands with and kissing a woman.
Tindall married the Queen's granddaughter, Zara Phillips, six weeks ago.
She has issued a statement saying the woman with her husband is an old friend.
However, the bouncer, who has been fired from his job, says he will plead not guilty and wants the case to go to trial.
