Ministry to appeal family carer ruling

The Ministry of Health has gone to the Court of Appeal in a bid to overturn a High Court ruling regarding funding for an Auckland woman who is supporting her disabled son.

In October last year, the High Court found that the ministry acted unlawfully in its handling of Margaret Spencer's application for funding when it refused to consider it.

The case followed legal action by other parents providing care for their disabled children who had successfully challenged the ministry over the issue.

The Court of Appeal hearing in Wellington is expected to run for two days.

Mrs Spencer and her son Paul Spencer, who is seriously disabled with Down's Syndrome, have travelled from Auckland to attend.
