College agrees student can return

A Hastings college has agreed that a pupil suspended for refusing to cut his hair can return to school on Wednesday.

In May this year, St John's College suspended Lucan Battison for breaching a school policy requiring him to have short hair, but his parents took High Court action seeking to have the suspension overturned.

The school has now agreed that the boy can return to school, pending a decision from Justice Collins, which is likely to be released before the school holidays in July.

The lawyer representing the school told the Wellington court on Monday afternoon that if the principal did not apply the school's rules that could lead to a breakdown in discipline. He said young men need to have boundaries.

But the Battison family's lawyer told the court the suspension breached the boy's bodily integrity and also breached the school's charter.

Joel Bates said the length of Lucan Battison's hair was not interfering with the educational system and it was not a distraction.
