WorkSafe will not be taking any legal action over the death of a nine-year-old boy after he was injured at Napier's Taradale Primary School.
Aryan Banerjee was strangled when his clothing got caught on a window latch as he tried to climb out of the bathroom near his classroom in May.
He had been stuck in the toilet unable to the open the door, which was being repaired and had been left unattended without a door handle.
The boy was found unconscious and struggling to breathe, and died in hospital in September.
WorkSafe's investigation found the circumstances which caused the death were not reasonably foreseeable, and no charges were legally justified.
His death will now be the subject of a coroner's inquest.
