Court dismisses appeal by mother jailed for perjury

The Supreme Court has refused to hear an appeal by a woman who was jailed for perjury in a custody battle over her son.

Kay Skelton and her father Dick Headley were convicted of abducting the boy, who was six, in November 2006.

The boy remained in hiding with his grandfather for five months in what was a custody dispute with the boy's father.

She was later sentenced in February 2010 to nearly three years in prison for giving false evidence about swabs sent to a laboratory for paternity analysis.

The Supreme Court says the Crown case against her was overwhelming, but she didn't plead guilty until the day before the trial, two years after being charged.

The court says if not detected, the perjury could have had consequences for both the boy and his real father.

It says Skelton was fortunate to get a four-month reduction in sentence for her guilty plea, and no miscarriage of justice is apparent.
