Fiji police are unable to confirm that Assistant Commissioner Henry Brown, who was put on leave pending an investigation into unspecified matters, is back at work as scheduled today.
Staff at the Intelligence Unit, where Mr Brown is usually based, now say he is not due in until tomorrow.
A police spokesperson says he is meeting with the police commissioner, Brigadier-General Sitiveni Qiliho, regarding the matter.
Police say the commissioner used powers under the constitution to move against Mr Brown in December while launching an investigation into serious in-house matters, adding the constitution supercedes the Police Act.
The Police Act makes no provison for sending an officer on leave but gives the commissioner the power to suspend an officer.
