2Day FM tries to block investigation into hoax royal phone call

Sydney radio station 2Day FM is trying to block further investigation of its royal prank phone call last year.

AAP reports the station has applied to the Federal Court for an order restraining the Australian Communications and Media Authority from continuing an investigation into the phone call in December 2012.

Nurse Jacintha Saldanha, 46, took her own life three days after 2Day FM DJs Mel Greig and Michael Christian duped her into passing them on to a ward nurse who gave details about the Duchess of Cambridge's stay at King Edward VII hospital in London.

The call was recorded and broadcast on air.

The ACMA began investigating 2Day FM, including an examination of whether the prank call breached its broadcasting licence.

But 2Day FM has applied to the Federal Court in an attempt to stymie that investigation.

Federal Court documents show the case is listed for a hearing in Sydney at 9.30am on 17 July.

The documents confirm 2Day FM (Sydney) Pty Ltd as the applicant and the ACMA as respondent.

AAP reports the ACMA investigation centres on whether or not 2Day FM breached a condition of its licence by using its broadcasting service in the commission of a criminal offence; namely using a surveillance device to record its prank call.

But 2Day FM will argue that the ACMA has no power to investigate whether use of a surveillance device constitutes an offence.
