The Royal Commission into the Christchurch mosque attacks has recommended the creation of a new offence under the Crimes Act, which would make it illegal to intentionally stir up hatred against racial or religious groups.
Offenders would face up to three years in prison.
But there's been criticism that gender identity and sexual orientation haven't been included in that recommendation.
