CNMI AG backs Fitial in power company row

The Attorney General of the Northern Marianas says the Governor, Benigno Fitial, is not liable for any cause of action related to his signing of the controversial no-bid 190-million US dollar diesel power purchase agreement.

Joey San Nicolas says Mr Fitial cannot be faulted because he reasonably relied on then Attorney General Edward Buckingham who certified that the power purchase agreement was proper as to form and capacity.

Mr Buckingham was forced to resign in August amid allegations of misconduct in public office.

Mr San Nicolas also determined that Mr Fitial did not possess the authority to enter into a deal with Saipan Development.
