Constitutionality of Papua's Act of Free Choice to be tested

15:04 pm on 15 April 2019

A group of West Papuans has applied for a judicial review of the process by which the former Dutch New Guinea was incorporated into Indonesia.

The Coalition of Lawyers for Truth and Justice of West Papuan People submitted its application to the Constitutional Court in Jakarta on behalf of Papuan customary representatives.

They claim the rights of West Papuans weren't respected during 1969's Act of Free Choice, as provided for under the New York Agreement between Indonesia and the Netherlands in 1962.

The plaintiffs argue their lawsuit is in line with the spirit of the Law of Special Autonomy for Papua Province granted in 2001

A member of the team which drafted the Law, Agus Sumule, says it's a bid to discuss the constitutionality of the process in a public and open way.
