E Tū will argue its case against the global airline catering company LSG Sky Chefs in the Employment Court in Auckland tomorrow.
LSG Sky Chefs, which is owned by the German airline Lufthansa, operates kitchens in Auckland, Wellington, Christchurch and Queenstown.
A union spokesman, John Ryall, said about 200 temp workers were contracted to the company through a third party.
He said many were paid only the minimum wage and did not have the security directly employed staff had.
Mr Ryall said they should be entitled to the same employment conditions.
