Two programmes hosted by Labour and New Zealand First candidates will be reported to police for breaches of laws relating to the election and broadcasting.
ACT Party candidate John Boscawen asked the Electoral Commission to investigate radio talkback programmes presented by New Zealand First leader Winston Peters and Labour Party MP Shane Jones.
Mr Jones' show has been found to have been an election advertisement which breached the Electoral Finance Act in failing to provide a promoter statement.
The decision hinged on occasions on which the two men mentioned who people should vote for.
Mr Jones was found to have made unsolicited statements to that effect, while the commission said Mr Peters was not in breach, because he had been responding to listener questions.
However, both programmes are being reported to police for offences under the Broadcasting Act.
That is because the talkback shows were deemed to be prohibited election programmes within the meaning of the Act.
