The lawyer representing church ministers of the Congregational Christian Church of Samoa for not paying taxes, has filed a motion for stay of proceedings and seek orders to quash the charges.
One of the grounds of the motion was that the specific fact that most of the defendants failed to withhold tax is an error of fact, as they had withheld and already paid the tax to the Ministry of Revenue.
The first 20 defendants appeared in the district court yesterday for the second time since the first mention of their cases last year.
The presiding judge has adjourned the matter to allow the Ministry of Revenue lawyers to respond to the application for stay of proceedings.
The defendants have yet to enter pleas.
